Rent Adjustment Program (RAP)

The Rent Adjustment Program (RAP) is a petition-based system for property owners and tenants of units covered under the Rent Adjustment Ordinance. Such tenants may file a petition with RAP to challenge certain rent increases, and/or for a decrease in rent paid due to a loss in service, code violations, and other grounds. Similarly, property owners must petition for certain rent increases based on grounds such as capital improvements, increased housing service costs, additional occupants, and others. RAP also provides housing counseling and mediation.

Allowable Rent Increases

As of August 1, 2024, the Allowable Annual Rent Increase for rental units covered under the Rent Adjustment Ordinance is 2.3%.

Request a Document/Public Records Request (PRR)

To request documents related to a case, you can make a Public Records Request (PRR). Please note that all PRRs are public information. You can look up certain information related to cases through the RAP database.

Request a Public Record

You can use our online portal to search for cases filed with RAP over the previous 12 months, and you can also search for any decisions issued by RAP. Owners and tenants can submit a Request for Copies form to request copies of case documents.

Petition and Response Review

You can schedule an appointment to review your petition or response for completeness before filing. To schedule an appointment, call us at (510) 238-3721, email us at: rap@oaklandca.gov, or schedule an appointment through our online scheduling portal.

Ellis Act Withdrawal of Rental Units

The Ellis Act allows property owners to remove rental units from the market. In Oakland, there are specific rules that owners must follow to do this. All paperwork for Ellis Act cases must be sent to 250 Frank Ogawa Plaza, Suite 5313, Oakland, CA 94612.
