FAQ: Oakland's Minimum Wage Law

In November 2014, Oakland voters passed Measure FF, which established the city minimum wage, required sick leave, and required payment of service charges to hospitality workers.

Summary

The law (Oakland Municipal Code Chapter 5.92) applies employers with employees who work 2 or more hours in a week. The requirements are:

  • City Minimum Wage Effective January 1, 2025: $16.89 per hour.
  • Sick Leave Rate: 1 hour of sick leave for every 30 hours worked.
  • Hospitality Employers that collect "service charges" must pay these to employees who rendered the service.

Regulations

Employers must post and give written notification of the Minimum Wage Law's provisions to each current employee and to each new employee at the time of hire.

Please note: Employers are prohibited from discharging, reducing compensation or otherwise discriminating against any person who makes a complaint under the ordinance.
